NATIONAL PARK EXPRESS WEBSITES Terms & Conditions

National Park Express (hereinafter “National Park Express” or “NPE”) is a wholly-owned subsidiary of CHD, Inc which acts in the capacity of an agent of transportation, attractions, shows, sightseeing and hotel accommodations. Coupons, tickets, and receipts issued by NPE, are subject to the terms and conditions stipulated by our company and the suppliers. NPE shall be exempt from any liability for loss or damage to property, injury of persons, accidents, delays, irregularities or other occurrences beyond its control, including from third parties. Every effort will be made to adhere to the published itineraries. NPE reserves the right to alter any itinerary at any time based on local conditions, and will not be responsible for losses incurred due to unforeseen circumstances. Tour prices are subject to change. NPE reserves the right to adjust the listed price at any time for any reason, however, we will not adjust prices once the booking has been confirmed and full payment has been received. Once a tour departs, there will be no refunds extended.

Should weather issues or other unforeseen circumstances cause a delay in our tour or transportation before the departure, NPE reserves the right to postpone or cancel, and any loss or additional expenses incurred shall be borne by the participants.

The listed tours are designed by NPE; we do our best to make sure all the tour arrangements and inclusions will be the same as planned. Should any unforeseen situation(s), such as traffic, road conditions, accidents, mechanical problems, public enemies, strikes, riots, political upheavals, authority of law, bad weather or any other natural circumstances beyond our control arise, local agents conducting the tour or our office staff reserve the right to alter the itinerary as necessary for the comfort and safety of the participants. Any additional expenses incurred shall be charged to the participants. Participants should strictly abide by the laws and regulations of the local governments. NPE will not be responsible for individuals, for any and all penalties due to any regulations of the governments of the cities, counties, countries, and other jurisdictions visited.

To ensure comfort, quality and safety, NPE reserves the right to accept, reject, or expel any individual who is deemed disruptive or incompatible with the interests, comfort and safety of the group. All expenses to do so will be borne by the passenger. NPE will not be responsible for the behavior of any tour participant. NPE reserves the right to make changes in the itinerary, or to cancel, whenever the Company deems it necessary for the comfort, convenience, or safety of the tour participants.

By accepting the booking, tickets, vouchers, documents, or electronic confirmations, the passenger agrees that neither NPE nor any of our representatives shall be liable for any loss, injury, or damage to you or your personal belongings, or in connection with any accommodations, transportation, or other services resulting directly or indirectly from any of the following: theft, mechanical breakdowns, government actions, political unrest, terrorism, strikes, lockouts, war, weather, natural disasters or other factors and causes beyond our control, acts of vandalism, air or land policy, burglaries, accidents, injuries, assaults or any physical harm to you or your personal belongings. NPE is not responsible for your failure to follow instructions including but not limited to hotel, tour or attraction check-in or check-out times, funds and payment methods, failure to obtain required documentation including passport, visas, health certificate, or others where required.

NPE reserves the right to change the planned inclusions, according to operational cost, hotel availability, or other causes, without prior notice. It is your own responsibility to follow all rules of third-party vendor partners, including avoiding smoking in non-smoking rooms, eating and drinking regulations, policies regarding alcohol, and any other policies and regulations pertaining to the destinations, companies or establishments visited.

NPE recommends that our customers acquire insurance on medical, trip cancellation, and general travel insurance. We act as agent for suppliers of transportation, sightseeing and hotel accommodations, all terms and conditions will be borne by the respective suppliers: NPE shall be exempt from any liability for loss or damage of properties, injury to people, delays, accidents, irregularities or other occurrences beyond its control.

Tour fare includes, transportation, ticket and admission fees mentioned in the itinerary. Tour fare excludes any personal expenses, such as phone calls, optional activities, food and drink not specifically included within the itinerary, travel or other insurance, gratuities to the Guide/Driver, any airport taxes and other related charges.

Prices on our websites are shown in U.S. dollars. If you are paying for your order with an international credit card, please note that the purchase price may fluctuate with exchange rates. In addition, your bank or credit card issuer may also charge you foreign conversion charges and fees, which may also increase the overall cost of your purchase. Please contact your bank or credit card issuer regarding these fees. NPE gift Cards or Canyon Express Passes are not refundable or cancelable.

National Park Express (hereinafter “NPE”) is a wholly-owned subsidiary of CHD, Inc which has prepared this Privacy Policy to help you understand how NPE collects, uses, and seeks to safeguard the personal information you provide to us on our websites, mobile applications, email, and through our service provider partners. We recognize that earning and retaining your trust is one of the most important things we do as a business. Protecting your privacy is a responsibility we take very seriously. This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third party, including any third-party distribution partners, suppliers, and any third party operating any site to which our websites contain a link. By downloading, accessing, or using our websites or content, or using an NPE application (“Application”) on a mobile phone, tablet or similar device (“Device”), or providing information to us in connection with our websites, mobile applications, or other sites or services, you agree to the terms and conditions of this Privacy Policy.

About us NPE is a travel company that offers tours, activities, and vacation packages online that enable users to research, find, and book travel experiences for their vacation. NPE’s products and services are made available through NPE and NPE-affiliated websites and applications.

This NPE website (including and together with CHD, Inc. and its other SUBSIDIARIES AND CORPORATE AFFILIATES branded websites) is where we offer our complete range of products and services directly to consumers. We also work with many affiliates who distribute our products and services to consumers through their individual websites. We typically host our affiliates’ product-information and booking pages, manage payment and credit card information. We also work with distributors who manage the hosting, purchase, and payment for our products and services. If you provide information directly to our affiliates, distributors, or suppliers, the terms of their respective privacy policies, and not this Privacy Policy will apply to such disclosures. You should carefully review the privacy policies of the affiliate partner, distributor, or supplier prior to providing information to such third parties.

What Information Do We Collect?

In general, we receive and store any information you enter on our websites or give us in any other way. We collect two types of information from you on our websites, mobile applications, via email, and through our service providers and distribution partners. Personal Information is information that identifies you personally, such as your first and last name, email address, telephone number, postal and email addresses, user name. We also collect Other Information that does not identify you personally, such as gender, country of residence, and other demographic information. When you register with NPE, we ask for basic information including your name and email address, and Other Information such as your signup location. You can choose not to provide information to us, but in general, some information about you is required in order for you to receive relevant offerings from NPE and its partners and enjoy other benefits of being a registered guest. For example, in order to purchase products or services, it is necessary for you to disclose Personal Information, including your name, address, email address, phone number, and other personally-identifying information. If you do not provide Personal Information when purchasing one of our supplier’s products or services, we cannot confirm your purchase or facilitate your booking. In some instances, we may also ask for Other Information such as demographic data, including your country of residence, gender, age, etc. We also use cookies (as discussed below) to collect information about the performance and usability of our websites.

Information About Others You may have the opportunity to provide contact and travel-related information for other people through our websites. If you “Refer a Friend” or if you make purchase products or services for someone else through NPE, you will need to submit that individual’s personal information. You must obtain the consent of other individuals prior to providing us with their personal information.

Information from Other Sources We also may periodically obtain both personal and non-personal information about you from affiliated entities, business partners, and other independent third-party sources and add it to other information about you. For example, if you visit NPE by “clicking-through” from a site operated by one of our business partners, and you have registered with that partner, then information about you that you have provided to that partner may be shared with us, such as contact information and demographic information. As another example, if you access third-party services, such as social media services, through our website or before coming to our website, we may collect information such as your user name and other information made available to us through those services. We will work with our existing partners and potential future partners to improve and personalize your use of our website in accordance with the practices outlined in this Privacy Policy.

Automatic Information When you visit NPE or any of our affiliates’ web pages that are hosted by us, our web server automatically recognizes and collects your IP address, which is assigned by your Internet Service Provider and does not identify you personally, web browser software, and referring website. To help us analyze the usage of our websites and related services, and to send more relevant communications to you, we also collect and keep track of Other Information about your online activity, such as content viewed, pages visited, and searches and/or reservations facilitated or made. One of our goals in collecting this automatic information is to help us understand the interests and preferences of our users and customize your user experience. For example, if you frequently visit Hawaii, we may send you special notices listing deals and popular products for Hawaii. If you are subscribed to any of our email marketing communications – including newsletters and destination alerts, it is necessary for you to disclose Personal Information such as your name and email address.

Payment Information If you book a tour or excursion with third-party suppliers facilitated by NPE we will collect payment information from you, including your credit card number, cardholder name, expiration date, authentication code, and billing address. We may offer members the option to save information related to the method and choice of payment on our websites. If you save such payment details on NPE, you will be able to add, delete, or modify that information at any time in your Account Settings. We do not share your payment details with any third-party supplier, distributor, or affiliate.

Location Information and Other Information from Devices When you use an Application on a Device, we will collect and use information about you in generally similar ways and for similar purposes as when you use NPE websites. In addition, we may collect information about your location if you have instructed your Device to send such information to the application via the privacy settings on that device, or if you have uploaded photos tagged with location information. We may use the location information collected from your device or photos to enhance your use of the application by providing you with relevant content and contextual advertising. For example, we may use your location to show you tours or excursions near you when you are traveling. You can change the privacy settings of your device at any time, in order to turn off the functionality to share location information with the Application and/or the functionality to tag your photos with location information. Please note that turning off location sharing may affect certain features of our application. If you have any queries about the privacy settings of your Device, we suggest you contact the manufacturer of your Device or your mobile service provider for help.

Your Contributions You can contribute to the NPE websites in a number of different ways, including writing reviews, uploading photos, filling out your public profile, and rating other users’ contributions. We may store these contributions (your “Content”), publicly display them on our websites and applications and those of our affiliate partners and distributors, display them to other users, share them with our affiliate partners and distributors, and use them for promotional purposes. Note that if you include Personal Information in your Content, it can be used and viewed by others. We are not responsible for the information you choose to include in your Content.

Cookies, and How We Use Them “Cookies” are pieces of information that are stored by your web browser on your computer’s hard disk, for record-keeping purposes. Cookies in and of themselves only identify your computer; they do not personally identify you. First-Party Cookies: At NPE we make use of cookies to help us recognize your browser as a previous visitor and save and remember any preferences that may have been set while your browser was visiting our site, record session information, collect information on how you visit and access our websites and Applications. We also may record your password in a cookie, if you checked the box entitled “Save this password for automatic sign-in.” Please note that member IDs, passwords, and any other account-related data included in such cookies are encrypted for security purposes. We also use cookies to help us customize the content, experience, and advertisements provided to you on our websites and Applications. and to analyze and measure the effectiveness of our email communications, website features and offerings, and advertisements.

Third-Party Cookies: NPE is committed to providing you with relevant content and information across our sites. To do this, we may collect information about your searches and other site activities and use third-party advertising companies to serve ads while you are visiting our websites and we permit these companies to place and access their own cookies on your computer in the course of serving advertisements. Such advertisers do not have access to the information we collect through NPE cookies. To opt-out of this targeted online advertising, please click here. Other companies’ use of their cookies is subject to their own privacy policies and not ours.

Web Beacons: Our websites also may use Web beacons (also known as clear gifs, pixel tags, or Web bugs), which are tiny graphics with a unique identifier, similar in function to cookies, that are placed in the code of a Web page. We use Web beacons to monitor the traffic patterns of users from one page within our sites to another, to deliver or communicate with cookies, to understand whether you have come to our site from an online advertisement displayed on a third-party website, and to improve site performance. We also may allow our service providers to use Web beacons to help us understand which emails have been opened by recipients and to track the visitor traffic and actions on our site. This helps us measure the effectiveness of our content and other offerings.

Data collected by business partners and ad networks to serve you with relevant advertising: Many of the advertisements you see on the NPE family of sites are served by NPE or its service providers; however, we also allow third parties to collect information about your online activities through cookies and other technologies. Response to Do Not Track signals: Your web browser may transmit a “Do Not Track” (“DNT”) signal to NPE and other websites. Because of differences in web browsers’ default settings and the manner in which browsers incorporate DNT signals, it is sometimes unclear to site operators whether site visitors have selected the DNT setting themselves, or whether they are aware that they have a choice in determining the setting. NPE does not currently respond to DNT signals. Once the Internet industry has settled on standards related to this issue and NPE recognizes such standards, we may reevaluate this approach. How We Use Your Personal Information?

Sharing with Social Media Services If you connect to NPE using Facebook, we may show you reviews, photos, and tours that your Facebook friends have posted, shared, saved or purchased on NPE. Note that, if you have Facebook friends who are using NPE, they may also share information about you with us through Facebook. If you wish to prevent that sharing, please review your Facebook privacy settings. You can also choose to access third-party social media websites and services through NPE (such as Facebook and Twitter). When you do so, you are sharing information with those sites, and the information you share is governed by their privacy policies. You may also be able to modify your privacy settings with these third-party social media websites.

Sharing with Service Providers Some of the Personal Information we collect is shared with our service providers (e.g. tour partners) who are directly involved in fulfilling the orders you have made from us. We provide our service providers with your (and your guest(s)) name(s) and your (and your guest(s)) local contact details if you provide them (e.g., your hotel name for pick-ups and drop-offs, your local phone number, your mobile phone number, your email address, etc.) We do not provide our service providers with any other Personal Information unless we otherwise notify you that such other Personal Information will be provided. If you decide to provide any Personal Information directly to a service provider, we recommend that you review the service provider’s privacy policy to determine how such service provider may use or disclose your Personal Information.

Sharing with Third-Party Vendors We also share your Personal Information with third-party vendors who provide services or functions on our behalf, including business analytics, payment processing, customer service, marketing, public relations, distribution of surveys or sweepstakes programs, and fraud prevention. We may also authorize third-party vendors to collect information on our behalf, including, for example, as necessary to operate features of our websites or Applications or to facilitate the delivery of online advertising tailored to your interests. Third-party vendors have access to and may collect information only as needed to perform their functions and are not permitted to share or use the information for any other purpose. We currently contract with several third-party online partners to help manage and optimize our Internet business and communications. We use the services of third-party marketing companies to help us measure the effectiveness of our advertising and how visitors use our website. To do this, we use web beacons and cookies provided by such marketing companies in connection with our websites. The information we collect helps us learn things like what pages are most attractive to our visitors, which of our products most interest our customers, and what kinds of offers our customers like to see. Sharing with Referring Websites If you were referred to NPE from another website, we may share your registration information, such as your name, email address, mailing address, telephone number and travel preferences, about you with that referring website. We have not placed limitations on the referring websites’ use of personal information and we encourage you to review the privacy policies of any website that referred you to NPE.

Sharing with Companies within our Corporate Family We may share your personal information within the NPE group of companies, affiliate companies, and websites. This sharing enables us to provide you with information about products and services, both travel-related and others, which might interest you. To the extent that our parent company and corporate affiliates have access to your information, they will follow practices that are at least as restrictive as the practices described in this Privacy Policy. They also will comply with applicable laws governing the transmission of promotional communications and, at a minimum, give you an opportunity in any commercial email they send to choose not to receive such email messages in the future.

Other Sharing We may also use or disclose Personal Information as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legitimate and enforceable subpoenas, court orders, or other legal process; (c) to respond to requests from public or government authorities, including public or government authorities outside your country of residence; (d) to enforce our terms and conditions or otherwise establish or exercise our legal rights; (e) to protect and defend our rights, property or safety or those of any of our affiliates, our customers, or others; (f) to protect our rights, privacy, safety or property, or that of our affiliates, you or others; (g) to allow us to pursue available remedies or limit the damages that we may sustain; (h) to investigate, prevent, or take action regarding illegal or suspected illegal activities; (i) in connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy; or (j) as otherwise required by law.

We may use and disclose Other Information for any purpose. In some instances, we may combine Other Information with Personal Information (such as combining your name with your geographical location). If we combine any Other Information with Personal Information, the combined information will be treated by us as Personal Information, as long as it is so combined. We also may share aggregate or anonymous information with third parties, including advertisers and investors. For example, we may tell our advertisers the number of visitors our website receives or the most popular excursions or tours. This information does not contain any personal information and is used to develop content and services we hope you will find of interest.

Email Communications You Can Expect to Receive from NPE. We may send to you marketing emails with information about NPE deals, destination, and product news, offers, competitions, and other special promotions that we believe that you will find valuable, interesting or informative. We will provide you with choices regarding our use of your Personal Information for marketing purposes. If you are no longer interested in receiving future email marketing communications from NPE, you have several choices for opting out of future mailings: – You may unsubscribe at any time by following the directions and link included in each email marketing message we send. – When you register as an NPE member, you may click on “My Account” at the top of any page of our website and update your “Account Settings” – You may email or call us and request to be unsubscribed.

Please note that, even if you opt-out of receiving future marketing communications from NPE, we will continue to send to you emails regarding your purchases and bookings, and regarding administrative information such as changes to our terms, conditions, and policies. If you make a booking or purchase at one of our websites, we may also send you information about new products, or ask your opinion about our websites, etc., so that we may improve our service to you and other consumers.

California resident privacy rights If you are a California resident, California law (i.e. CCPA) provides you with additional rights regarding our use of your personal information. Subject to certain exceptions, California residents have the following rights regarding their personal information: Access to Personal Information and Data Portability Rights. The right to request that we disclose certain personal information to you about our collection and use of your personal information.

Deletion Request Rights. The right to request we delete any of the personal information we’ve collected from you and retained (subject to exceptions granted under law). To exercise a request described above, a California resident may file a request here. We will not discriminate against a California resident for exercising any of their rights.

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website. By participating in a tour, you grant National Park Express permission to use your likeness in a photograph in any and all publications and materials without payment or other consideration.

Contact forms – Cookies

If you leave a comment on our site you may opt-in to saving your name, email address, and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Who we share your data with – How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Standards of Business Policy

We don’t allow, nor will we tolerate any form of harassment or discrimination on the basis of race, ethnicity, nationality, religion, color, sex, sexual orientation, age, marital status, disability, pregnancy or any other basis prohibited by applicable law.

We strive to provide a workplace, and client environment free from any form of harassment or discrimination.

We believe in having and promoting a respectful, professional environment and expect every employee, and business partner, to show respect for all of our colleagues, customers, and vendors. Harassment by co-workers, supervisors, or any third party is a form of misconduct that destroys our positive environment and undermines the integrity and mission of our company. Our company is committed to providing a work environment and guest experience that is free of any unlawful discrimination, including harassment based on any legally protected status. The Company will not tolerate any form of discrimination or harassment that violates this policy. This policy applies to all employees of CHD, Inc., National Park Express, and Canyon Coach Lines at all locations.

All of our workers, at every level, will be subject to necessary discipline, up to and including discharge, for any violation of this policy. Employees are prohibited from harassing or discrimination of other employees, clients, or third parties whether on or off the employee premises, within our outside of the scope of work hours. We post our policy internally, physically, digitally and share publicly on our website, to inform all employees, partners and clients.

Sexual Harassment Policy

Employees are prohibited from any form of sexual harassment of other employees, clients, or third parties whether on or off the employee premises, within our outside of the scope of work hours. This includes any or all locations, during tours, transportation or while visiting attractions. We are committed to providing an environment free from any form of sexual harassment.

Defining Sexual Harassment

Sexual harassment is defined as any unwelcome conduct of a sexual nature that is offensive or persistent and interferes with an employee’s job performance or guest experience, or which creates an intimidating, offensive or hostile environment. Sexual harassment, as defined by the federal Equal Employment Opportunity Commission, is any unwelcome sexual advances, any requests for sexual favors, other verbal or physical conduct of a sexual nature. For example: submission to such conduct is made either explicitly or implicitly as a term or condition of an individual’s initial or continued employment; submission to or rejection of such advances or conduct by an individual when used as the basis for any employment decisions; or any such conduct that has the intent or result of unreasonably interfering with the work performance of an individual, or creating a hostile or offensive working environment or guest experience. Sexual harassment can be psychological and/or physical in nature. An

accumulation of more minor incidents can constitute sexual harassment situation, even individual incidents might not be considered harassment.

Examples of Prohibited Conduct

Though sexual harassment can be defined and executed in a number of ways and methods, some examples of prohibited conduct include would include:

Unwelcome sexual advances, verbal sexual comments, sexually oriented gestures, noises, remarks, jokes, or comments about a person’s sexual preference, interest or sexual experience.

Physical assaults of any sexual nature including rape, molestation, sexual battery, or discussion/attempts to commit these assaults, suggestive touching, pinching, patting, holding, brushing against another employee’s body or grabbing of another employee’s body.

Any preferential treatment or indications of preferential treatment to an individual for submitting to sexual activity or conduct, including soliciting or attempting to solicit any individual to engage in sexual activity for compensation or reward, or intentionally making performance of the employee’s job more difficult because of that employee’s unwillingness to submit to such actions.

Retaliation for Sexual Harassment Complaints

If an employee or client feels that he or she is a subject of sexual harassment he or she may immediately inform the harasser that the conduct is inappropriate and needs to stop; if the conduct does not stop, or if the individual is unable to or uncomfortable in addressing the alleged harasser directly, he or she should report the incident to his or her own supervisor or to the human resource HR Director, Tessa Tang, ttang@chdestination.com . It is helpful, but not required, to provide a written record of the date, time and nature of the incident(s) and the names of any witnesses.

All concerns or complaints of sexual harassment or inappropriate sexual conduct must be reported as soon as possible. All reports and claims will be addressed and investigated, and the company will take any necessary action to prevent or remediate the prohibited conduct from continuing or recurring.

Managers who knowingly allow or tolerate any sexual harassment or retaliation, which includes the failure to immediately report any misconduct to HR, stand in violation of this policy and subject to discipline, and up to dismissal.

After any reporting, our HR Manager will work to make sure all involved are aware of the seriousness of a sexual harassment complaint, as the investigation proceeds, and will explore options to resolve the situation, including informal resolution, arranging for a more formal investigation, and notifying the police in the case of any potentially criminal activities. A written report will be made preliminarily, as well as in summary of the investigation. The complainant and the respondent will be notified of the corrective actions to be taken, if any, and the execution of those actions.

The HR Manager will determine whether the case will proceed as an in-house investigation, or if a third party will be contracted to proceed with the investigation.

Complaint Resolution Procedures

Complaints should be submitted, in writing, if possible, as soon as possible after an incident has occurred. The HR Manager may assist the complainant in completing a written statement or, if requested. The following should be included within the written complaint: the name, and position of the person or persons allegedly committing harassment; a detailed description of the incident, including the date, location and the listing of any witnesses; the names of others who might have been subjected to similar harassment; listing of any attempts made to rectify the situation. All reports will be taken seriously and handled expeditiously.

Discipline

Employees who violate this policy are subject to appropriate discipline, even including written reprimand, possible dismissal, and may also be subject to civil damages or criminal penalties.

Confidentiality

Complaints and investigations are treated in a confidential manner, to the extent possible and information is disclosed strictly on a need-to-know basis. The identity of the complainant is normally revealed to the parties involved and the HR Manager necessary measures to ensure that the complainant is protected from any retaliation during the investigation, and after its resolution.

Other Available Procedures

Procedures that are available under this policy do not preempt or supersede legal procedures or remedies that may be otherwise available to a victim of sexual harassment under local, state or federal laws or mandates.

Procedure

Our outlined step-by-step procedure in addressing a situation will include: informing both parties of next steps; begin thorough investigation; come to a conclusion, making an unbiased determination base on facts; establishment of next steps such as written warnings, termination, training, or determining that no harassment has occurred; communication of results to both parties; ensuring that future workplace situations are free from harassment.

Service animals, defined as dogs that are individually trained to do work or perform tasks for a person with a disability, are allowed on our tours, except for tours that include Antelope Canyon where service animals are not allowed.  Only dogs are recognized as service animals under titles II and III of the ADA. Service animals are defined as dogs that are individually trained to do work or perform tasks for people with disabilities. Examples of such work or tasks include guiding people who are blind, alerting people who are deaf, pulling a wheelchair, alerting and protecting a person who is having a seizure, reminding a person with mental illness to take prescribed medications, calming a person with Post Traumatic Stress Disorder (PTSD) during an anxiety attack, or performing other duties. The work or task a dog has been trained to provide must be directly related to the person’s disability. Dogs whose sole function is to provide comfort or emotional support do not qualify as service animals under the ADA. This definition does not affect or limit the broader definition of “assistance animal” under the Fair Housing Act or the broader definition of “service animal” under the Air Carrier Access Act.

A service animal must be under the control of its handler. Under the ADA, service animals must be harnessed, leashed, or tethered, unless the individual’s disability prevents using these devices or these devices interfere with the service animal’s safe, effective performance of tasks. In that case, the individual must maintain control of the animal through voice, signal, or other effective controls.
